Who Can Use My Services

• If using on behalf of an organization, you represent that you have authority to bind that organization
• My services are available to clients worldwide

What I Build

I do not guarantee:

• Uninterrupted or error-free service
• Specific business outcomes from your AI solution
• Compatibility with all third-party platforms or their future versions
• That AI outputs will always be accurate — AI systems can make mistakes, and you are responsible for reviewing critical outputs

My process is designed to be simple and direct. Here's how we'll work together:

You agree to use my Services only for lawful purposes and in accordance with these Terms.

Prohibited Activities

Content Guidelines

Your AI solution and its content must not:

• Contain defamatory, libelous, or threatening content
• Infringe on intellectual property rights of others
• Promote discrimination, hate speech, or harassment
• Spread misinformation or false claims
• Be used to deceive, impersonate, or defraud individuals
• Violate any applicable laws

My pricing and billing terms are as follows:

Engagement Models

Payment Terms

• A 50% advance payment is typically required before work begins on fixed-scope projects
• The remaining 50% is due upon project completion and delivery
• I accept payments via secure payment providers (and other methods by mutual agreement)
• Prices are inclusive of applicable taxes unless otherwise stated
• Custom quotes are valid for 30 days from the date of issue

Refund Policy

What You Own

Upon final payment, you own the AI solution I build for you, including:

• The custom code, configuration, and design created specifically for your project
• Your text, images, logos, data, and brand assets
• Product, service, and business information you supply
• Data collected through your solution

What I Retain

I retain ownership of:

AI and Model Ownership

Where I use third-party AI models or services, you receive a license to use the delivered solution but not the underlying models or APIs, which remain the property of their respective providers and are governed by their terms.

I reserve the right to showcase your solution in my portfolio unless explicitly requested otherwise.

Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Services will be uninterrupted or error-free
• Defects will be corrected
• The Services are free of viruses or harmful components
• The results of using the Services will meet your requirements
• AI-generated outputs will always be accurate or appropriate for your use case

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WEBDEVPRO SHALL NOT BE LIABLE FOR:

By You

You may cancel a project at any time by notifying me via email. Upon cancellation:

• Work on your project will cease immediately
• I'll delete your project data according to my Privacy Policy
• No refunds for work already completed
• Outstanding fees for completed work remain due and payable

By Me

I may decline or terminate a project if:

• You breach these Terms or my Acceptable Use Policy
• I receive valid legal requests requiring termination
• The project scope changes significantly from my initial agreement
• Communication becomes unresponsive for an extended period

Effect of Termination

Upon termination, all licenses granted to you under these Terms will terminate. Provisions that by their nature should survive termination will remain in effect.

You agree to indemnify and hold harmless WebDevPro from any claims, damages, losses, or expenses arising from:

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which I am based.

Jurisdiction

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

Resolution Process

I prefer to resolve disputes amicably. Please contact me at contact@webdevpro.in before initiating formal proceedings.

Entire Agreement

These Terms, together with my Privacy Policy and any other agreements incorporated by reference, constitute the entire agreement between you and WebDevPro.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.

Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including acts of God, war, terrorism, or natural disasters.
